1. Acceptance

These Terms of Service (the "Terms") are a legally binding agreement between you and MinouMood Team ("MinouMood Team", "we", "us", or "our"). They govern your access to and use of the MinouMood mobile application and related services (collectively, the "App" or "Services").

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility (17+)

The Services are intended for users aged 17 and older. By using the Services, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

3. The Services

MinouMood helps you manage your pet’s wardrobe by letting you store outfit details (such as size, brand, and occasion), take and organize photos, compare styles side-by-side, and use filtering tools to find the right outfit.

We may add, modify, or remove features at any time to improve the Services or comply with legal and platform requirements.

4. Accounts

4.1 Registration and Information

If you create an account, you agree to provide accurate information (such as name, username, and email) and keep it updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

5. License and Acceptable Use

5.1 License

Subject to your compliance with these Terms, MinouMood Team grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use.

5.2 Restrictions

  • Do not misuse the Services or interfere with their normal operation.
  • Do not access or use the Services in any unlawful manner or for any unlawful purpose.
  • Do not attempt to gain unauthorized access to accounts, systems, or networks.
  • Do not reverse engineer, decompile, disassemble, or attempt to derive source code from the App except where permitted by law.
  • Do not copy, modify, distribute, sell, lease, or sublicense the App or any part of the Services except as expressly permitted by these Terms.

6. User Content

6.1 Your Content

The Services may allow you to upload, store, or generate content, such as photos and outfit information ("User Content"). You retain ownership of your User Content.

6.2 Permission to Operate the Services

You grant MinouMood Team a limited license to host, store, process, and display your User Content solely to provide, maintain, and improve the Services and as otherwise described in our privacy practices.

6.3 Your Responsibilities

You are responsible for your User Content and represent that you have the necessary rights to upload and use it, and that it does not violate any laws or the rights of others.

7. Privacy

Our privacy practices are described in our Privacy Policy provided separately. By using the Services, you acknowledge that information may be collected and used as described in that policy.

8. Fees and Subscriptions

Unless we tell you otherwise in the App, the Services are provided free of charge. If we introduce paid features, we will provide additional terms and disclosures at that time.

9. Third-Party Services

The Services may rely on or integrate with third-party services (for example, operating system features or service providers we use to host and maintain the Services). We are not responsible for third-party services that you use independently.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, MinouMood Team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Services.

MinouMood Team’s total liability for any claim arising out of or related to the Services will not exceed the amount you paid to use the Services in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if we must do so to comply with law, or to protect the security or integrity of the Services.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Effective Date" above when changes become effective. If changes are material, we will take reasonable steps to notify you (for example, through the App).

14. Governing Law; Dispute Resolution; Arbitration

14.1 Governing Law

These Terms are governed by the laws of the jurisdiction of MinouMood Team’s principal place of business, without regard to conflict of laws principles.

14.2 Binding Arbitration

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, rather than in court.

The arbitration will be conducted in the primary place of business of MinouMood Team (or another location agreed by the parties), in English, by a single arbitrator, under the rules of a recognized arbitration provider or rules agreed by the parties. The arbitrator may award any relief permitted by applicable law.

14.3 Injunctive Relief

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse, infringement, or unauthorized access.
